В статье исследуются отдельные вопросы применения запрета определенных действий в качестве меры пресечения. Проанализированы предлагаемые учеными позиции, изучена судебная практика по применению запрета определенных действий. На этой основе систематизирован и представлен круг обстоятельств, который может выступить в качестве оснований для принятия решения об отмене и изменении запрета определенных действий. Рассмотрены и обозначены и другие вопросы, возникающие при применении меры пресечения в виде запрета определенных действий.
The article examines individual issues of applying the prohibition of certain actions as a preventive measure. The positions proposed by scholars are analyzed, and judicial practice on the application of the prohibition of certain actions is studied. On this basis, a range of circumstances that can serve as grounds for making a decision to cancel and change the prohibition of certain actions is systematized and presented. Other issues arising when applying a preventive measure in the form of a prohibition of certain actions are also considered and identified.
